These Terms and Conditions (“Terms”) govern your access to and use of the EventKing platform, including our website, applications, dashboards, and related services (collectively, the “Services”). By accessing or using EventKing, you agree to be bound by these Terms. If you do not agree, you may not use the Services

1. About EventKing

EventKing (“EventKing,” “we,” “us,” or “our”) is a software platform that enables event organizers to create, manage, market, and sell tickets for events. EventKing is not an event organizer, is not a ticket seller, and is not the merchant of record for any transactions conducted through the platform. All events are created, owned, and operated solely by third-party event organizers (“Organizers”).

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use EventKing. By using the Services, you represent and warrant that:

  • You meet all eligibility requirements.
  • All information you provide is accurate and current.
  • You will comply with all applicable laws and regulations.

3. Account Registration

To use certain features, you must create an account. You are responsible for: maintaining the confidentiality of your login credentials; all activity that occurs under your account; and immediately notifying us of unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Role of EventKing (Important)

EventKing acts solely as a technology platform. We do not control, host, sponsor, or organize events; we do not set ticket prices; we do not process payments; we do not issue refunds; and we do not handle chargebacks or disputes. All financial transactions are processed by third-party payment processors, including Stripe, and are subject to their terms and policies.

5. Payments, Fees, and Transactions

All ticket payments are processed directly between event attendees, event organizers, and Stripe (or another integrated payment processor). EventKing is not the merchant of record for any transaction. Any platform or service fees charged by EventKing are for software access and usage only and are separate from ticket payments. EventKing does not hold, store, or transmit payment funds, does not handle taxes, does not manage payouts, and does not resolve payment disputes.

6. Chargebacks, Refunds, and Disputes

All chargebacks, payment disputes, refunds, and fraud claims are the sole responsibility of the event organizer and are handled through Stripe or the relevant payment processor. EventKing is not liable for denied refunds, event cancellations, fraudulent purchases, or disputes between organizers and attendees. Organizers are responsible for clearly communicating their refund and cancellation policies to attendees.

7. Taxes

Event organizers are solely responsible for determining applicable taxes, collecting taxes, and reporting and remitting taxes to the appropriate authorities. EventKing has no responsibility or liability related to taxes.

8. Organizer Responsibilities

If you are an event organizer, you agree that you are solely responsible for event accuracy and legality, compliance with all local, state, and federal laws, venue agreements, permits, and insurance, attendee safety and conduct, and content uploaded to EventKing. EventKing reserves the right to remove events that violate laws or these Terms.

9. Attendee Responsibilities

If you purchase or register for an event through EventKing, you enter into a direct agreement with the event organizer and agree to the organizer’s event rules and policies. EventKing is not responsible for event quality, event cancellations or changes, entry denial, lost tickets, or attendee disputes.

10. Prohibited Use

You may not use EventKing for illegal or fraudulent purposes, misrepresent events or ticket availability, circumvent fees or payment systems, upload malicious code, or interfere with platform operations. Violation may result in suspension or termination.

11. Intellectual Property

All EventKing content, software, trademarks, and designs are owned by EventKing or its licensors. You may not copy, modify, or distribute any part of the platform without written permission.

12. Third-Party Services

EventKing integrates with third-party services (including Stripe). We are not responsible for third-party services, outages, errors, or policies. Use of such services is subject to their respective terms.

13. Disclaimer of Warranties

EventKing is provided “as is” and “as available.” We make no warranties regarding platform availability, event accuracy, payment processing, or revenue or ticket sales success. Use of the platform is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, EventKing shall not be liable for lost profits, lost data, event cancellations, fraud or chargebacks, payment disputes, or personal injury or property damage at events. Our total liability shall not exceed the fees paid to EventKing in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless EventKing from any claims, damages, losses, or expenses arising from your use of the platform, your events, your violation of laws or these Terms, or disputes with attendees or third parties.

16. Termination

We may suspend or terminate access to EventKing at any time for violations of these Terms. Termination does not relieve you of obligations incurred prior to termination.

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New York County, New York.

18. Changes to These Terms

We may update these Terms at any time. Continued use of EventKing constitutes acceptance of the updated Terms.
